i made payment for $25 to someone in usa and i have not recieved my item,if i wait 21 days and want a refund what should i do?

should i be asking the seller first then auctionchex.

basicly what is the process of obtaining a refund.obviously because my item would not have been recieved by me.its now 17 days gone by and i aint holding any hope of it arriving.i think if it isnt here after 21 days i can most certainly say it wont be arriving.its from usa and i am in uk.
